These Terms of Service govern your use of the Instapay website and platform operated by Instapay ("we," "us," or "our"). Please read these terms carefully before using our platform. Instapay is a technology platform in development, not a bank, and does not currently offer financial services.

By accessing or using the Instapay website or platform, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, do not use the Instapay platform. These Terms of Service constitute a legally binding agreement between you and Instapay. Your continued use of the platform after any changes to these terms constitutes acceptance of the updated terms.
Instapay is currently in pre-launch development. Real-money transfer services are not currently available through this website or app. Any future financial services will be subject to partner, bank, compliance, and regulatory approval. Nothing on this platform constitutes an offer of financial services. Joining the Instapay waitlist does not create a financial relationship, guarantee access to future services, or obligate Instapay to provide any specific product or service. Features, fees, limits, and availability are subject to change before and after launch.
To use the Instapay platform, you must be at least 18 years of age and a resident of a jurisdiction where Instapay's services are permitted by applicable law. By using the platform, you represent and warrant that you meet these eligibility requirements. Instapay reserves the right to refuse service to anyone for any reason at any time, including if we determine that you do not meet our eligibility requirements or that your use of the platform poses a risk to Instapay, our partners, or other users.
To access certain features of the Instapay platform, you may be required to create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify Instapay immediately at [email protected] if you suspect unauthorized access to your account. Instapay is not liable for any loss or damage arising from your failure to protect your account credentials.
If and when real-money financial services become available, Instapay will be required by law to verify the identity of users before allowing access to payment features. This may include collecting government-issued identification, date of birth, address, and other information required to comply with Know Your Customer (KYC) and Anti-Money Laundering (AML) regulations. Instapay reserves the right to suspend or restrict access to any account that fails to complete required identity verification or that provides false or misleading information during the verification process.
You agree not to use the Instapay platform for any of the following purposes: • Fraud, money laundering, terrorist financing, or any other illegal activity • Impersonating another person or entity, or providing false identity information • Attempting to gain unauthorized access to Instapay's systems, accounts, or data • Transmitting malware, viruses, or other harmful code • Harassing, threatening, or harming other users or Instapay personnel • Violating any applicable local, state, national, or international law or regulation • Using the platform for any purpose that Instapay determines, in its sole discretion, to be harmful, abusive, or contrary to these terms Violation of these prohibitions may result in immediate account suspension, termination, and referral to law enforcement authorities.
Instapay does not currently process, hold, transmit, or facilitate real-money transfers of any kind. The platform is in pre-launch development only. Any representation that Instapay currently offers live payment services is inaccurate. Do not attempt to send money, share financial account credentials, or make payments through the Instapay platform at this time. Instapay is not responsible for any losses resulting from attempts to use the platform for financial transactions before real-money services are officially launched.
Any future payment services offered by Instapay will be subject to approval from partner financial institutions, bank sponsors, compliance reviewers, and applicable regulatory authorities. Instapay makes no guarantee that any specific service, feature, or product will be made available at any particular time or at all. Future services may be provided through approved third-party financial partners. The terms, fees, limits, and availability of those services will be disclosed before they are made available to users.
Instapay reserves the right to suspend, restrict, or permanently close any account at any time, with or without notice, for reasons including but not limited to: • Violation of these Terms of Service • Suspected fraud, illegal activity, or security risk • Failure to complete required identity verification • Inactivity for an extended period • Requests from law enforcement or regulatory authorities • Instapay's discontinuation of the platform or a specific feature If your account is closed, you will be notified at the email address associated with your account where required by law.
You are solely responsible for your use of the Instapay platform and for any content or information you provide. You agree to use the platform only for lawful purposes and in accordance with these terms. You are responsible for ensuring that your use of the platform complies with all applicable laws and regulations in your jurisdiction. Instapay does not provide legal, financial, or tax advice. You should consult qualified professionals for guidance specific to your situation.
All content on the Instapay platform — including text, graphics, logos, icons, images, and software — is the property of Instapay or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on the platform without Instapay's prior written consent. Nothing in these terms grants you any license or right to use Instapay's trademarks, trade names, or branding without express written permission.
THE INSTAPAY PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. INSTAPAY DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. INSTAPAY IS NOT A BANK AND DOES NOT CURRENTLY OFFER FINANCIAL SERVICES. NOTHING ON THIS PLATFORM CONSTITUTES FINANCIAL, LEGAL, OR INVESTMENT ADVICE. INSTAPAY MAKES NO REPRESENTATIONS REGARDING THE AVAILABILITY, ACCURACY, OR COMPLETENESS OF ANY INFORMATION ON THE PLATFORM.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, INSTAPAY AND ITS OFFICERS, DIRECTORS, EMPLOYEES, PARTNERS, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM, EVEN IF INSTAPAY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL INSTAPAY'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE PLATFORM EXCEED ONE HUNDRED DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
Instapay reserves the right to update or modify these Terms of Service at any time. We will notify users of material changes by posting the updated terms on this page with a revised "Last updated" date. For significant changes, we may also send notice to the email address associated with your account. Your continued use of the platform after changes are posted constitutes your acceptance of the updated terms. If you do not agree to the updated terms, you must stop using the platform.
